THE CONSTITUTION (REMOVAL OF DIFFICULTIES) ORDER NO. IV
C. O. 16, dated the 24th May, 1950
In exercise of the powers conferred by clause (1) of article 392 of the Constitution of India, the President is pleased to make the following Order, namely :--
1. (1) This Order may be called the Constitution (Removal of Difficulties) Order No. IV.
(2) It shall be deemed to have come into force on the twenty-sixth day of January, 1950.
2. The Second Schedule to the Constitution of India shall have effect subject to the following adaptations :--
1(1) In sub-paragraph (3) of paragraph 9, for the words, "the salary which he was drawing immediately before such commencement "the words" the salary payable to the Chief Justice or, as the case may be, any other Judge of the Federal Court immediately before such commencement" shall be substituted.
(2) In sub-paragraph (2) of paragraph 10, for all words after clause (b) the following shall be substituted :--
"shall, in respect of time spent on actual service as such Chief Justice or other Judge, as the case may be, be entitled to receive in addition to the salary specified in sub-paragraph (1) of this paragraph as special pay the amount, if any, by which that salary falls short of the salary payable to the Chief Justice, or as the case may be, any other Judge, of the High Court in the Province immediately before such commencement."
