Act Info:

(1) This Act may be called the Bombay Prevention of Begging Act, 1959.

(2) It extends to the whole of the 1[State of Maharashtra].

(3) It shall come into force in any area of the State, on such dates2 as the State Government may, by notification in the Official Gazette, appoint in that behalf for that area.

(4) On the commencement of this Act in any area of the State in the manner provided in sub-section (3), all corresponding laws in force in that area (including the laws mentioned in the Schedule, to the extent specified in the third column thereof) shall stand repealed therein :

Provided that, notwithstanding such repeal anything done or any action taken (including any appointment made, receivng centres and institutions provided, maintained, certified, approved or recognized, authorizations given, powers conferred and duties imposed, committes appointed or constituted, licences granted, notifications issued and rules made) under any law so repealed, shall in so far as it is not inconsistent with the provisions of this Act, be deemed to have been done or taken under the corresponding provisions of this Act; and shall continue in force accordingly unless and until superseded by anything done or any action taken under this Act. And, without prejudice to the aforesaid provision and subject thereto, section 7 of the Bombay General Clauses Act, 1904, shall apply in relation to the repeal of any such law, and if such law be not an enactment within the meaning of that section, it shall apply in relation thereto as if it were an enactment within the meaning of that section.

In exercise of the powers conferred by sub-section (3) of section 1 of the Bombay Prevention of Begging Act, 1959 (Bom. X of 1950), the Government of Bombay hereby appoints the 1st April, 1960 to be the date on which the said Act shall come into force in the following areas:-

(a) "Greater Bombay" as defined in the Bombay General Clauses Act, 1904;

(b) The part of Thana taluka which is encircled by the Bessein-Thana Creek including the territorial waters appertaining thereto;

(c) The limits of Railway lands from a point immediately beyond the Bhayander Railway Station to the Kalyan Station inclusive on the Central Railway; and

(d) The limits of Railway lands from a point immediately beyond the Bhayander Railway Station to the Virar Railway Station includes on the Western Railway;

(e) The "Elephanta Caves" comprised in Survey No. 65 in village Gharapuri in Urban Mahal of the Kolaba District;

(f) The City of Ahmedabad within the meaning of the Bombay Provincial Municipal Corporation Act, 1949.

In exercise of the powers conferred by sub-section (3) of section 1 of the Bombay Prevention of Begging Act, 1959 (Bom. X of 1960), the Government of Maharashtra hereby appoints the 15th day of February, 1964, to be the date of which the said Act shall come into force in the following areas, that is to say :-

(a) The areas within the limits of the Municipal Corporation of the City of Poona;

(b) The areas within the limits of the Cantonment Boards of Poona and Kirkee.

In exercise of the powers conferred by sub-section (3) of section 1 of the Bombay Prevention Begging Act, 1959 (Bom. X of 1960), the Government of Maharashtra hereby appoints the 1st day of April, 1974 to be the date on which the said Act shall come into force in the City of Nagpur within the meaning of the City of Nagpur Corporation Act, 1948 (C.P. and Berar II of 1950).

*No. MIS. 1095/CR-111, dated 10th October, 1996.--In exercise of the powers conferred by sub-section (3) of section 1 of the Bombay Prevention of Begging Act, 1959 (Bom. X of 1960) the Government of Maharashtra hereby appoints the First day of November, ] 996 to be the date on which the said Act shall come into force in the areas within the limits of Solapur District.

No. BPA. 2005/CR-121/D-8, dated 18th October, 2005.--In exercise of the powers conferred by sub-section (3) of section 1 of the Bombay Prevention of Begging Act, 1959 (Bom. X of 1960), the Government of Maharashtra hereby appoints the dated 18th day of October, 2005 to be the date on which the said Act shall come into force in the area within the limits of Satara Districts.

*No. BPA. 2005/CR-143/D-8, dated 29th June, 2007.-Whereas, the Government of Maharashtra, by Government Notifications issued, from time to time in exercise of the powers conferred by sub-section (3) of section 1 of the Bombay Prevention of Begging Act, 1959 (Bom. X of 1960). has brought into force the said Act in the areas of Greater Bombay, Thana Taluka, limits of Railway lands from a point immediately beyond the Thana Railway Station to the Kalyan Station inclusive on the Central Railway, and beyond the Bhayander Railway Station to the Virar Railway Station inclusive on the Western Railway, Elephanta Caves, City of Ahmedabad within the meaning of the Bombay Provincial Municipal Corporations Act, 1949; in the areas within the limits of the Minicipal Corporation of the City of Poona and in the areas within the limits of the Cantonment Boards of Poona and Kirkee; in the area of City of Nagpur within the meaning of City of Nagpur Corporation Act, 1948; in the areas within the limits of Ahmednagar District; in the areas within the limits of Solapur District and in the areas within the limits of Satara District.

And whereas, the Government of Maharashtra now considered it expedient to bring into force the said Act in the remaining areas of the State of Maharashtra also;

Now, therefore, in exercise of the powers conferred by sub-section (3) of section 1 of Bombay Prevention of Begging Act, 1959 (Bom. X of 1960), the Government of Maharashtra hereby appoints the 29th day of June 2007 to be the date on which the said Act shall come into force in the remaining areas of the State of Maharashtra.

1. These words were substituted for the words "State of Bombay" by the Maharashtra Adaptation of Laws (State and Concurrent Subjects) Order, 1960.
