Title : Short Title and Extent

(1) This Act may be called the Arya Marriage Validation Act, 1937.{ Subs, by the A. Title : Marriage Between Arya Samajists Not to Be Invalid

Notwithstanding any provision of Hindu Law, usage or custom to the contrary no marriage contracted whether before or after the commencement of this Act between two persons being at the time of the marriage Arya Samajists shall be invalid or shall be deemed over to have been invalid by reason only of the fact that the parties at any time belonged to different castes or different sub-castes of Hindus or that either or both of the parties at any time before the marriage belonged to a religion other than Hinduism. Title : Effect of Foreign Awards

(1) A foreign award shall, subject to the provisions of this Act, be enforceable in {Substituted by Act 3 of 1951,Section 3 and Sch, for "the States".} [India] as if it were an award made on a matter referred to arbitration in {Substituted by Act 3 of 1951,Section 3 and Sch, for "the States".} [India] (2) Any foreign award which would be enforceable under this Act shall be treated as binding for all purposes on the persons as between whom it was made, and may accordingly be relied on by any of those persons by way of defence, set off or otherwise in any legal proceedings in {Substituted by Act 3 of 1951,Section 3 and Sch, for "the States".} [India] , and any references in this Act to enforcing a foreign award shall be construed as including references to relying on an award. Title : Filing of Foreign Award in Court

(1) Any person interested in a foreign award may apply to any Court having jurisdiction over the subject-matter of the award that the award be filed in Court. (2) The application shall be in writing and shall be numbered and registered as a suit between the applicant as plaintiff and the other parties as defendants. (3) The Court shall direct notice to be given to the parties to the arbitration, other than the applicant, requiring them to show cause, within a time specified, why the award should not be filed. Title : Enforcement of Foreign Award

(1) Where the Court is satisfied that the foreign award is enforceable under this Act, the Court, the Court shall order the award to be filed and shall proceed to pronounce judgment according to the award. Title : Conditions for Enforcement of Foreign Awards

(1) In order that a foreign award may be enforceable under this Act it must have--- (a) been made in pursuance of an agreement for arbitration which was valid under the law by which it was governed, (b) been made by the tribunal provided for in the agreement or constituted in manner agreed upon by the parties, (c) been made in conformity with the law governing the arbitration procedure, (d) become final in the country in which it was made, (e) been in respect of a matter which may lawfully be referred to arbitration under the law of {Substituted by Act 3 of 1951,Section 3 and Schedule for "States"} [India]. and the enforcement thereof must not be contrary to the public policy or the law of {Substituted by Act 3 of 1951,Section 3 and Schedule for "States".} [India]. (1) The Party seeking to enforce a foreign award must produce (a) the original award or a copy thereof duly authenticated in manner required by the law of the country in which it was made; (b) evidence proving that the award has become final; and (c) such evidence as may be necessary to prove that the award is a foreign award and that the conditions mentioned in clauses (a), (b) and (c) of sub-section (1) of section 7 are satisfied.
