prakash krishna, j. 1. this appeal is against the original judgment of the court below. the facts of the case unfolds the usual story--sale of entire property of the deceased by one of the co-heirs, after getting mutated in his or her name surreptitiously and the vendor falls back on section 41 of the transfer of property act to protect the sale. 2. durga datt mahay (father of the plaintiff and of defendants no. 1 to 5) was the owner in possession of the property described as kf-94, new kavi nagar, ghaziabad, u.p., a residential house having two storey building. he was perpetual lessee of the plot from ghaziabad development authority. he retired as an additional district magistrate (judicial) in the year 1969 from meerut. after his retirement, he got constructed the house thereon. sri durga datt mahay constructed ground floor and and resided in the front portion with his wife ratna mahay (somewhere typed as ratna devi) and with his one of the daughters km. kamlakshi mahay who was mentally and physically handicapped. durga datt mahay had seven daughters. during his life time unfortunately, one of his daughters namely smt. vashundhara sharma became widow on 15th of september, 1980. he permitted the widowed daughter to construct first floor under a registered instrument dated 6th of september, 1981. sri durga mahay expired on july 9, 1987. he left behind him his widow smt. ratna mahay, seven daughters namely smt. usha sharma (plaintiff), smt. chanchal sharma (defendant no.1), .....

1. by means of this writ petition, the petitioner is challenging the order dated 20.11.1999 passed by the respondent no. 3-prescribed authority at mahoba by which his name has been removed from the revenue records over gata no. 240 area 1.44 acres. 2. the admitted facts of the case are that while proceedings of ceiling had already been initiated by the state government against the original tenure holder shri jayendra singh, the petitioner purchased a portion of the land in respect of which ceiling proceedings had already been initiated being gata no. 240 area 1.44 acres situate in mauza kulpahar district mahoba. on the basis of the sale deed dated 26.5.1975 the petitioner applied for mutation and mutation was also allowed on 26.3.1996. in paragraph 5 of the writ petition, the petitioner has admitted that during the mutation proceedings it was well within his knowledge that the land which he had purchased was under ceiling proceedings. the petitioner has sought to derive support from an order passed in writ petition no. 6548 of 1988 filed by the respondent nos. 4,5 and 6 who are stated to be the sons of jayendra singh. copy of the order of the high court dated 3.5.1996 has been filed as annexure-3 to the writ petition and from a reading of the same it is seen that the said writ petition was filed for setting aside the order dated 7.11.1977 rejecting a restoration application of respondents no. 4,5 and 6. there is no mention in the order of the high court regarding any ceiling .....

mrs. sunita agarwal, j. heard shri ram dhani singh, learned counsel for the petitioner and shri m.k. srivastava, learned counsel appearing for the respondents. the writ petition has been filed challenging the judgement and order dated 12.9.2003 passed by the additional civil judge(j.d.), haveli, varanasi and also the order dated 4.12.2003 passed by the district judge, varanasi. by means of aforesaid orders, issue no.3 framed in original suit no. 1180 of 1998 (ravi shanker prasad singh vs. babu ram and others) was decided against the petitioner-defendant and it was held that suit is maintainable before the civil court. brief facts giving rise to the present writ petition are that the land in dispute belong to raja ram son of ram sumer resident of village adampur, pargana shivpur, district varanasi. raja ram died on 4.1.1987. petitioner babu ram(now deceased) and respondents no. 5 and 6 claimed their right in the disputed land as heirs of raja ram, (deceased). the plaintiff-respondents no. 3 and 4 claimed their right in the disputed land on the basis of sale deed dated 27.6.1989 alleged to have been executed by mohan son of bali ram prasad, nirmala devi wife of sohan and rita devi wife of raj kumar residents of village imaliya, pargana katehar, district varanasi. mohan, nirmala devi and rita devi mentioned above claimed their right in the disputed land on the basis of sale deed dated 19.4.1985 alleged to have been executed by raja ram(deceased). mohan and others claimed their .....
